Agreement to Terms

By accessing or using the FUNDOOR platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Platform.

Description of Service

FUNDOOR provides a real estate platform that connects buyers and sellers across the United States. Our services include property listings, search functionality, communication tools, and transaction facilitation without traditional banking requirements.

User Accounts

Registration

To access certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Account Termination

We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms or fraudulent activity.

Property Listings

Listing Requirements

When listing a property, you must:

• Have legal authority to list the property
• Provide accurate and truthful information
• Include all material facts about the property
• Comply with all applicable laws and regulations
• Not engage in discriminatory practices

Listing Content

You retain ownership of the content you post, but grant FUNDOOR a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with operating the Platform.

Prohibited Content

You may not post content that:

• Is false, misleading, or fraudulent
• Violates any law or regulation
• Infringes on intellectual property rights
• Contains malware or harmful code
• Is offensive, abusive, or harassing

Transactions

Platform Role

FUNDOOR is a platform that facilitates connections between buyers and sellers. We are not a party to any transaction and do not act as an agent, broker, or fiduciary. All transactions are between users.

User Responsibility

Users are responsible for conducting their own due diligence, obtaining professional advice, and complying with all applicable laws. We recommend consulting with real estate attorneys, home inspectors, and other professionals.

Fees and Payments

FUNDOOR may charge fees for certain services. All fees will be clearly disclosed before you incur them. You agree to pay all applicable fees and authorize us to charge your payment method.

Prohibited Activities

You agree not to:

• Use the Platform for any illegal purpose
• Impersonate another person or entity
• Interfere with or disrupt the Platform
• Attempt to gain unauthorized access to any part of the Platform
• Use automated systems (bots, scrapers) without permission
• Circumvent security features
• Collect user information without consent
• Engage in fraudulent or deceptive practices

Intellectual Property

The Platform and its original content, features, and functionality are owned by FUNDOOR and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works, publicly display, or exploit any content from the Platform without our express written permission.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY LISTINGS OR USER CONTENT. YOU USE THE PLATFORM AT YOUR OWN RISK.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUNDOOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR GOODWILL.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify and hold harmless FUNDOOR and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Platform, violation of these Terms, or infringement of any rights of another.

Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Arbitration

Any dispute arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to a jury trial or to participate in a class action.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Platform after changes constitutes acceptance of the new Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
